By accessing or using artgumi.com (the "Website"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Website.

2. About ArtGumi
​

ArtGumi is a digital art community and marketplace that connects artists with buyers. We provide a platform for artists to sell their artwork, including digital goods and physical products. ArtGumi operates as a community initiative, and our service fee (10% of net sales) is used to support community activities, exhibitions, and platform maintenance — not for personal profit.

3. User Accounts
​

3.1 Account Creation You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Account Eligibility You must be at least 13 years old to use our services. If you are under 18, you must have parental or guardian consent.

​

4. Products and Purchases
 

4.1 Product Listings

Products on ArtGumi are created and sold by independent artists. While we strive to ensure accurate product descriptions, ArtGumi does not guarantee the accuracy of product information provided by artists.
 

Most items are handmade or one-of-a-kind artworks. Due to their handcrafted nature, minor variations and imperfections are normal and part of what makes each piece unique. These are not considered defects.
 

4.2 Pricing

All prices are displayed in USD. Customers may see prices converted to their local currency at checkout through Stripe's Adaptive Pricing. Final prices include applicable fees and may vary slightly due to currency conversion.
 

4.3 Payment

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. You will receive a receipt from Stripe as required by Thai regulations.

5. Refund Policy
​

All sales are final due to the unique nature of handmade artwork.

​

Most items sold on ArtGumi are one-of-a-kind pieces that cannot be replaced. Please review product descriptions and images carefully before making a purchase.

​

If items arrive damaged, buyers must contact ArtGumi at hello [at] artgumi.com within 7 days of delivery with photos of the damage and order details. For fragile or high-value items, we strongly recommend recording a video while opening the package as evidence. Claims without documentation or submitted after 7 days may not be processed.

​

ArtGumi will connect buyers with the artist. For minor damage, the artist may be able to provide repair guidance. For significant damage where insured shipping was used, the artist may file a claim with the shipping carrier. ArtGumi facilitates communication but cannot guarantee resolution, replacement, or compensation.

​

Artists are encouraged to use tracked and insured shipping for fragile works. Buyers should understand the inherent risks of shipping fragile, one-of-a-kind items.

6. Disputes

6.1 Dispute Resolution If you have a dispute regarding a purchase, please contact us at hello [at] artgumi.com. ArtGumi will serve as the central point of communication between buyers and artists to help resolve disputes.

6.2 Artist Responsibility Individual artists are responsible for resolving disputes related to their products, including issues with product quality, shipping, and accuracy of descriptions. ArtGumi will facilitate communication but is not liable for disputes between buyers and artists.

7. Shipping

For physical products:
 

  • Items are shipped directly by artists and may arrive in separate packages.

  • Shipping terms and costs are determined by individual artists and displayed at checkout.

  • Free shipping may be offered at the artist's discretion.

  • Shipping times vary by artist and destination.

  • Customs and import fees may apply depending on regulations of the destination.

  • ArtGumi is not responsible for delays, lost packages, or customs fees.

  • Buyers are responsible for providing accurate shipping information.

 

8. Intellectual Property

8.1 Artist Content Artists retain ownership of their intellectual property. By listing products on ArtGumi, artists grant us a non-exclusive licence to display and promote their work on our platform.

8.2 Buyer Rights Purchasing a product grants you personal use rights, including the right to resell the physical item. You may not reproduce or commercially use the artwork without explicit permission from the artist.

​

9. Prohibited Content
​

The following content is not permitted on ArtGumi:

​

  • Content that infringes on intellectual property rights

  • Illegal, harmful, or offensive material

  • Content promoting violence, discrimination, or hate

  • Fraudulent or misleading content

 

We reserve the right to remove any content that violates these terms.

 

10. Limitation of Liability

ArtGumi is a marketplace platform. We are not responsible for the quality, safety, or legality of products sold by artists. To the maximum extent permitted by law, ArtGumi shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services.

11. Modifications
​

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to the Website. Continued use of the Website after changes constitutes acceptance of the modified terms.

12. Governing Law
​

These Terms of Service are governed by the laws of Thailand. Any disputes shall be resolved in the courts of Thailand.
